TERMS & CONDITIONS
*The reference, in this document of dog, shall be the one referred to above, the breeder/seller shall be DIRT ROAD KENNELS (Jimmy Ray or Amy Horne); the buyer shall be referred to as the owner.
*Deposits are NON-REFUNDABLE, unless by fault of the seller. Should the Buyer decide not to purchase the pup, or fail to pay it out by the agreed time, the deposit will be forfeited. We accept U.S. Postal Money Orders No personal checks! NO CASH REFUNDS--NO EXCEPTIONS
*DIRT ROAD KENNELS will ship puppies in the U.S.
*Should the buyer decide that he/she no longer wants the pup/dog, they must first offer it back to the Seller at a reasonable price or the purchase price so he can sell it to another party. The offer must be in writing.
*DIRT ROAD KENNELS guarantees the dog to be current on all vaccinations and worming at the time of purchase unless otherwise stated. DIRT ROAD KENNELS cannot be held responsible for health defects due to Buyer's negligence regarding vaccinations and worming after date of sale.
*Buyer agrees to notify Seller on a yearly basis as to the dog's condition, provide current photo to Seller, and advise DIRT ROAD KENNELS, in writing, of any changes in address or phone numbers.
*Buyer will immediately notify DIRT ROAD KENNELS if dog is sold, given away, stolen, lost, or deceased. NOTE: Subsequent owners must also agree to this entire Sales Agreement & sign their acceptance.
*Buyer agrees to socialize the pup/dog and keep it in a good healthy condition (ex. regularly worming), and to feed it a good quality food & water.
*The breeder reserves the right to inquire about and inspect the dogs housing and quarters. If the breeder finds the dog is in an unsanitary and/or poor health condition, the Breeder has the right to take the dog back from the owner with no compensation to the owner!
*Buyer agrees that this said puppy/dog would not be used for any inhumane, immoral, or illegal purposes. Under no circumstances is Buyer ever to fight, roll or face off pup/dog with another dog. DIRT ROAD KENNELS has the right to take back possession of said puppy/dog without compensation to owner. All provisions in this contract are designed to safeguard the puppy/dog, the breed in general (APBT), and/or the community.
*If purchasing a male dog from the breeder, buyer agrees it must allow stud service with a waiver of any stud fee upon breeder's request. Breeder is responsible for paying all shipping or artificial insemination fees. Buyer/owner will give signed service agreement to Seller at the time of breeding. DIRT ROAD KENNELS reserves first pick (However many that may be), Buyer/owner will have second pick (if they wish to purchase a pup from the breeding), and then puppies will be available to the public.
*If purchasing a female dog from the breeder, buyer agrees the female will not be bred before her second heat cycle. Also, the buyer will use NuVet Vitamins once the female has been bred until she has weaned the pups. This will significantly increase the opportunity of a healthy pregnancy and delivery for the dam & a wonderful start for her pups.

*Dogs when introduced to new surroundings are sometimes inclined to exhibit shyness and inactivity. In some instances, they may refuse to eat. After becoming adapted to their new environment they will readily accept you as their new master and the food you offer. Your care and attention will aid in overcoming the shyness of the new quarters.
-Maintain a sound-feeding program
-Insure continued health by regular veterinarian check-ups
-Proper exercise for the dog's mental and physical well-being.
-The love, dedication, responsibility, and care you give to your dog will be returned many times over in the years ahead.
*Should the dog be determined genetically or physically in ill health (this does not include communicable diseases) within 7 days after taking possession of the dog, the cause which is clearly attributable to the seller, the dog may be returned with a written diagnosis from two licensed veterinarians for another dog of equal value, if one is not available at that time the buyer will have to wait for another litter. (These shipping costs are the responsibility of the buyer.)
*DIRT ROAD KENNELS agrees to provide buyer with the proper registration papers. The U.K.C. registered name of the pup will be 'HORNE'S _____________________'. Under no circumstances will the name ever be changed on the U.K.C. certificate. Subsequent owners must also agree to this entire Sales Agreement and sign their acceptance. Please note: If seller has not received the registration papers from U.K.C. or A.D.B.A. Before the puppy leaves our kennel, we will mail them to the buyer as soon as we receive them. If we are shipping the puppy to you, we will mail the papers to the buyer.
*DIRT ROAD KENNELS must be notified whenever the dog wins any titles or championships.
*Should the Buyer break this agreement in any way, ownership of the pup/dog reverts back to the Seller. At Seller's option, they may confiscate the pup/dog immediately and without any compensation due to the Buyer.
*The undersigned do hereby accept this agreement in its entirety and acknowledge that this is a legal and binding agreement/contract. Each party is in receipt of a signed and dated copy of this agreement.
